Yes, when knowledge-based assessments are generally lawful
The federal U.S. Equal Employment Opportunity Commission (EEOC) permits tests and other selection procedures (cognitive tests, skills tests, work-sample tests, etc.) as part of hiring and promotion—including for safety-sensitive jobs—as long as the tests are "job-related" and consistent with business necessity.

The use of pre-employment tests (cognitive/knowledge/skills) is lawful, provided they measure "skills or aptitude" relevant to the job and are administered properly.
As long as all applicants for a given job are treated the same (the test is administered uniformly to everyone applying for that role), this helps avoid unlawful "disparate treatment."

In other words: For a safety-sensitive position (e.g., a role where failing to perform properly could result in risk to health or safety), it is reasonable for an employer to use a test that checks whether the candidate has the knowledge, cognitive skills, or judgment necessary to do the job safely.
Each EHSINDEX assessment costs $299.00. This flat rate applies to all assessment types including OSHA 1910, OSHA 1926, USACE EM-385.1.1, MSHA PART 46, MSHA PART 48, and DOT/FMCSA. There are no hidden fees or subscription requirements—you pay per assessment.
